Job Overview
Provide strategic and timely legal advice to Laurent Energy Partners in the practice area for which each lawyer has or is developing expertise. It is recognized that Counsel at LEP have earned a Bachelor of Laws degree and most have additional university degrees. In addition, they are members in good standing with the Law Society of Upper Canada and must retain that status.
Key Accountabilities
Prepare and process payroll end-to-end process including new hire onboarding, timesheet allocation, pay cycle processing, and pay adjustments in compliance with all collective agreements and in accordance with established policies and procedures.
- As members in good standing with the Law Society of Upper Canada, lawyers are held to a high standard of ethics. Counsel at LEP is required to practice with integrity and are to comply with LEP's governance, including the Code of Business Conduct.
- Band G Senior Counsel have developed significant expertise in their practice area. They are required to continue developing expertise in their practice area.
- Band G Senior Counsel have significant knowledge of LEP's business, organization and business goals. This knowledge is required in order to provide legal advice appropriate to the company.
- Educating clients about legal matters and developments in their practice area.
- Errors can be minor or great and most would not be detectable until well after a decision is made. Errors could create corporate liability, impact corporate budgets, and corporate finance. In addition, errors could result in major projects being delayed or cancelled, litigation liability, negatively impact external and internal stakeholders and LEP's reputation, and negatively affect labour relations.
- Identifying practical and effective strategies for pursuing LEP's goals. Advising LEP clients at all levels on those strategies and options. Band H counsel may require assistance from other lawyers in the department.
- Identifying pro-active projects that will provide legal education to LEP clients and developing those projects.
- In addition to liaising with internal stakeholders at all levels of the organization, Counsel will liaise with and represent LEP with external stakeholders. External stakeholders may include LEP's shareholders, government bodies and ministries, suppliers, external counsel engaged by LEP, the supplier community, opposing legal counsel, arbitrators, mediators and union representatives. Band H counsel is responsible for developing effective relationships with all internal and external stakeholders with whom their practice area requires them to communicate.
- It is also recognized that many of the above work functions are complex, time sensitive and may involve stating or taking unpopular positions in order to provide the best legal service to LEP. This can cause stressful situations for counsel.
- It is recognized that in carrying out the above work functions, simple to complex problems are being considered and there is little or no instruction, procedure or policy to follow in determining advice or direction. Band G Counsel may consult with others in the Law Division on advice or direction in order to provide the best service to LEP but can and do work independently.
- Liaising and working effectively with clients at all levels of the organization. Understanding the levels of the organization and roles. Developing skills to persuade, advocate for and work with others who may not have legal expertise. Must be able to explain problems, issues and options and persuade employees, at varying levels of the organization, about various problems and strategies. Exercising and continuing to develop managerial courage to raise unpopular or difficult issues and concerns.
- Participating proactively in core teams in major initiatives, projects and proceedings, including in development of contracting strategies for engineering and construction agreements, agreements with First Nations, cost recovery agreements and financing agreements (and execution of the strategies).
- Providing strategic and legal advice concerning changes to policies, practices and procedures.
- Representing LEP in mediations and before various courts and tribunals. This may entail research, drafting pleadings and briefs, preparing witnesses for oral testimony, preparing cross and direct examinations. Requires effective written and oral advocacy.
- Staying current on the law which will include statutory changes, significant case law, and prevailing legal strategy.
- Working independently or with others, as appropriate, draft legal contracts in response to client needs. This may include contracts for the purchase of supplies, contracts for major transactions, acquisitions or joint ventures, or employment and labour related contracts.
- Working independently to research an issue, including legal precedents. Must be able to identify legal issues, practical barriers, and options that will work best for the LEP business. Senior Counsel will develop and provide strategic advice to other lawyers within the Law Division and clients within LEP. Must be able to effectively and concisely draft legal opinions and memoranda of law on these issues.
