Deputy General Counsel, Policy and Litigation

EEI employees are required to work in office Monday-Thursday, and have the option to work remotely on Fridays.

KEY RESPONSIBILITIES OF THE DEPUTY GENERAL COUNSEL, POLICY & LITIGATION:

The Deputy General Counsel, Policy & Litigation works closely with the Chief Legal officer and manages a team to develop EEI’s legal, policy, and litigation positions on a range of state and federal matters. The Deputy General Counsel, Policy & Litigation provides legal support to and collaborates closely with other departments within EEI to respond to state and federal regulations, policies, proposals, and initiatives that are directly and indirectly related to the utility business model, electricity markets and rates, emerging technologies, grid infrastructure, energy supply, and broader policies. The Deputy General Counsel, Policy & Litigation serves as a senior legal lead on priority EEI member initiatives projects, such as wildfire advocacy, nuclear development, large load policies, sustainability, and other complex matters requiring senior leadership.

Other important responsibilities of the Deputy General Counsel, Policy & Litigation, include:

Legal, Regulatory & Policy Leadership

- Guide legal strategy and policy responses to major federal and state regulatory actions, including matters arising at DOE, FERC, NRC, FCC, FAA, CFTC, SEC.

- Manage policy-related litigation matters, including amicus briefs, administrative litigation and other litigation matters stemming from EEI’s advocacy.

- Coordinate closely with the EEI Environment team on various issues related to federal financial support for the electric sector and sustainability.

- Monitor and assess emerging legal, regulatory, and policy trends impacting the electric sector, proactively identifying implications for EEI members and developing advocacy strategies.

- Manage special projects in close coordination with the Chief Legal Officer.

Member Engagement & Committee Leadership

- Provide support to the general counsel committee on litigation, ensuring all litigation matters are aligned with member needs and policy objectives and other EEI executive advisory committees as needed.

- Engage directly with EEI members at senior levels to understand operational, legal, and regulatory challenges and translate those insights into effective advocacy and policy strategies.

- Represent EEI leadership in member meetings, briefings, and strategic discussions, including serving as a panelist or speaker at EEI and industry events.

- Assist with planning various EEI member meetings, including speaking on panels and securing speakers.

Cross-Departmental & External Collaboration

- Collaborate closely with EEI’s Environment, Government Affairs, FERC, and Security teams and other internal departments to ensure coordinated advocacy and consistent messaging on emerging policy issues.

- Work with EEI members and other EEI departments, including EEI’s Chief Legal Officer, to respond to legal, regulatory, and policy issuances and engage with EEI members to develop member consensus positions.

- Work with the Communications and Research teams and other EEI departments to review internal and external communications.

REQUIRED & PREFERRED QUALIFICATIONS:

- Juris Doctor (J.D.) degree from an accredited law school. Active bar membership in good standing (D.C. Bar or eligibility for admission). Equivalent years of work experience is accepted.

- 15+ years of progressively responsible legal experience or equivalent skills or knowledge, with at least 5 years of experience focused on clean energy, environmental, or regulatory law.

- Demonstrated experience with major federal statutes impacting the electricity sector.

- Strong understanding of utility law, energy markets, and regulatory frameworks affecting electric companies.

- Exceptional legal research, writing, and advocacy skills.

- Ability to lead legal strategy in high-stakes, high-profile regulatory and policy matters.

- Strong interpersonal skills and ability to work collaboratively with diverse stakeholders.

- Travel requirement: As needed to attend member meetings and industry events relevant to the position.

COMPENSATION

The salary range for this role is $282,900-$389,300. Starting annual salary will be determined on individual qualifications. EEI also offers an annual performance incentive which is prorated for mid-year start dates.
