About The Role
A Right of Way Agent, also known as an Acquisition Agent or Land Agent, is a professional responsible for acquiring and managing real estate interests, easements, and other property rights needed for infrastructure projects. This role involves negotiating with property owners, ensuring compliance with legal requirements, and facilitating the acquisition of land for public or private development projects.
Key Responsibilities
•Identify and evaluate properties required for infrastructure projects, such as highways, pipelines, utilities, or telecommunications.
•Negotiate with property owners to acquire necessary rights of way, easements, and land interests through purchase or other legal means.
•Title Research and Due Diligence:
•Conduct title searches and due diligence to assess property ownership, legal restrictions, and encumbrances.
•Collaborate with legal and surveying professionals to resolve title issues and ensure clear and marketable title.
•Negotiate fair and equitable terms with property owners for the acquisition of land or property rights.
•Determine and calculate compensation for property owners based on appraisal values, market conditions, and project requirements.
•Collaborate with project managers, engineers, legal counsel, and other stakeholders to understand project requirements and coordinate land acquisition efforts.
•Communicate with government agencies, utility companies, and affected parties to address concerns and facilitate the acquisition process.
•Prepare and review legal documents, including contracts, easements, and right of way agreements.
•Ensure compliance with federal, state, and local laws and regulations governing land acquisition and property rights.
•Communicate effectively with property owners, local communities, and other stakeholders to build positive relationships.
•Address concerns, provide information, and represent the organization in public meetings or hearings as needed.
•Recordkeeping and Reporting:
•Maintain accurate records of property transactions, negotiations, and related documentation.
•Generate reports and updates for project management and other relevant stakeholders.
Key Qualifications
•Bachelor's degree in Real Estate, Land Management, Business, or a related field.
•Proven experience as a Right of Way Agent or in a similar role.
•Knowledge of real estate principles, land acquisition processes, and legal aspects of property rights.
•Strong negotiation and communication skills.
•Familiarity with title research and due diligence procedures.
•Ability to work collaboratively with multidisciplinary teams.
•Understanding of relevant laws, regulations, and industry best practices.
Key Info
Right of Way Agents may work in both office settings and in the field, conducting site visits, meeting with property owners, and attending public hearings. Travel may be required depending on the location of the projects.
